V. Judiciary
Article 30
The whole
judicial power is vested in a High Court and in such inferior courts as are established by law. No extraordinary tribunal shall be established, nor shall any organ or agency of the Executive be given final judicial
power. All judges are independent in the exercise of their conscience and bound only by this Constitution and the laws.
Article 31 [Public Impeachment]
Judges shall not be
removed except by public impeachment unless judicially declared mentally or physically incompetent to perform official duties. Any executive organ or agency shall administer no disciplinary action against judges.
Article 32 [High Court]
The High Court shall be composed of three Justices, including a Chief Justice. Each Justice shall be chosen from a group of declared candidates. The King shall
choose one Justice, the second by the Cabinet, and the third by the Assembly. Upon the removal of more than half the Members of the Cabinet who chose the Justice, either a new Justice shall be appointed, or the same one
reaffirmed. Upon new elections of the Assembly, the new Assembly shall appoint a new Justice, or reaffirm the sitting Justice.
Article 33 [Chief Justice]
The Chief Justice shall
be chosen by the Members of the High Court from amongst themselves, and upon the consent of the King, shall take office. The Chief Justice shall serve as the presiding officer of the High Court.
Article 34 [Terms of Judges]
The terms of Judges and Justices shall be fixed by law or determined by the King.
Article 35 [Jurisdiction of the High Court]
The High Court is the court of last resort with power to determine the constitutionality of any law, order, regulation, or official act.
Article 36 [Public Trials]
Trials shall
be conducted and judgment declared publicly. Where a court unanimously determines publicity to be dangerous to public order or morals, a trial may be conducted privately, but trials of political offenses, offenses
involving the press or cases wherein the rights of people are in question shall be always conducted in public.
