Descendants of William Maxfield
of Windham, Maine

Generation One

1. William1 Maxfield was born in 1724 in possibly, Ireland. One report (unknown source) has William born on board ship on the trip from Ireland to Marblehead in 1724.1 He married Susanna Webb, daughter of Samuel Webb and Bethia Farrar, on 4 Nov 1753 in Gorham, ME.1 He married Mary Wescott, daughter of William Wescott and Dorcas Skillings, on 21 Mar 1763 in Windham, ME; the date of marriage could have been July, if the March date was derived from the Quaker recording of the third month.1,2 He died in 1775 in Windham, ME.

He came to Windham from Marblehead as a "young man" and an apprentice to second settler William Mayberry. On 27 Aug 1747, in Windham, ME, William Maxfield was followed by a party of some twenty or thirty Indians, they entered the town and made an attempt to capture two young men who were out of the fort, William, son of Thomas Bolton, and William Maxfield who lived with William Mayberry. They were both well armed with muskets and made a brave resistance. Bolton discharged his musket upon his assailaants, but before he could reload the Indians rushed upon him and made him a prisoner. Maxfield retreated, walking backwards towards the fort, and occasionally menacing the Indians with his gun, till he was rescued by a band of armed men from the garrison, but not till he had been seriously, though not fatally, wonded by a shot from the Indians, having an arm broken. Bolton was carried captive to Canada, where he was purchased by a French naval officer and taken on board a French frigate as a servant. The french frigat was soon captured by an English vessel and taken to Boston, and Bolton became the servant of Lt. Wallace, of the English frigate. But his stuation becoming known to the captain of a coasting vessel belonging to Falmouth, he was released on application to the Governor, and brought home to the great joy of his parents.3

"An account of the Settlement at New Marblehead and by who made this 26 April 1758" [Quoted from the Archives of Mass. vol 117, page 481] No.1, School Lot unsettled. No.2, 8 acres of Land Cleared. Dubble Houses No. 3, Ditto. Settled by Maxwell & Mayberry 1755 on 26 Apr 1759 in New Marblehead, ME.4  -- This means, he settled on Home Lot No. 2, on which he built a "double house" and had eight acres of land cleared in 1759. He also owned the adjoining lot, No. 4, on which he had a like number of acres cleared.5

On 6 Oct 1761, William Maxfield purchased from Abraham Anderson, a 50 acre lot or half of Lot.1 of the Second Division on the river and on the School Lot. No. 1 of the First Division in New Marblehead, ME.6 He appeared on the in 1762 census of the first parish, New Marblehead, ME, as head of family.7 He promises to sell back to Abraham Anderson the same land on 27 Apr 1763 in New Marblehead, ME.8 He (Maxwell) sells the same land to John Thomas, Jr., this time with a house and a barn on it on 26 Aug 1764 in Windham, ME.9 He (Maxwell) purchases the same land from John Thomas, Jr. at a profit on 18 Sep 1764 in Windham, ME.10 He was (Maxwell) sells the same land, house and barn, to Stephen Woodman of Falmouth and again makes a profit on 20 Sep 1765 in Windham, ME.11

He, "one of the early settlers," became the owner of Home Lot No. 2, adjoining the school lot. This gentleman appears to have used somewhat original methods in his transactions, and his ideas of the eternal fitness of things were evidently of a vague and undefined nature, especially in regard to boundry lines. It is a fact that, when he built his house, it stood one half on his own lot and the other half on the school lot. By virtue of this novel "livery of seizen," he kept possession for several years without being called to account; and he also claimed the right to operate on the hundred acre lot drawn for the school in 1740. This he proceeded to do for some time.

"At length the authorities, fearing that he might gain a possessory title to the entire township, ordered him to vacate the premises. This he refuses to do and so the matter rested for some years. Finding that he was likely to ruin the lot, the matter was brought before the town at a meeting held on May 7, 1774, when it was "Voted that William Elder, Richard Dole and David Barker is a committee to sue William Maxfield off the School Lot, if he refuses to give it up, and likewise to dras so much money out of the Treasury as is needful to carry on the same."

"This committee immediately notified Mr. Maxfield of the vote and informed him that they should at once proceed to enforce it according to law. Finding himself confronted by a probable law suit, after considerable bluster on his part, he finally concluded to vacate the disputed territory."12
